Terms of Use

1. Agreeing to these terms

These Terms of Use apply when you visit luxewell.com, sign up for updates, take the Healthy Home Quiz, create an account, or order a Home Baseline. By using the site or ordering, you agree to them. If you do not agree, please do not use the site.

When you order, you also accept short order agreements shown in full on the checkout page: the terms of the assessment, your responsibility for the instruments, and how your stored payment method may be used. Those agreements state the amounts and dates for your order. If anything in these Terms conflicts with an order agreement you accepted, the order agreement governs that order. Our Privacy page explains how we handle your information and is part of these Terms.

2. Who we are

luxewell.com and the Home Baseline are operated by Rhodium Ventures LLC, a Georgia limited liability company, under the name Luxewell (“Luxewell,” “we,” “us”). You can reach us at jared@luxewell.com or 770-769-5518.

3. What we provide

The Home Baseline measures the indoor environment of your home over about a week. We ship you a box of cases holding instruments we own, one case for each room measured. You open each case in its room and leave it open, the instruments record, then you close the cases and send them back in the same box. We then issue you a written report about what was measured. The order page and your order agreements describe exactly what your order includes.

Your water test comes from an independent laboratory, not from Luxewell. It ships to you in its own box, separately from ours, and you send your sample straight to the laboratory with the prepaid label in that box. The laboratory tests the sample and sends the results to us for your report, so your report waits for them. We do not control the laboratory's timing or methods.

The site also offers free material: the Healthy Home Quiz, articles about what we measure, and pages about our homebuilding work and the Home OS. These are general information. A quiz score reflects only your answers, not measurements of your home. Anything about building or installing in a home is information only, and any such work would be done under its own separate written agreement.

4. Not medical, inspection or professional advice

The Home Baseline and your report are for your own information. They are not medical advice, and they do not diagnose, treat or prevent any illness or condition. If you have a health concern, talk to a qualified health professional. Comparing a reading with a published guideline is general information, not a finding about anyone's health.

The report is not a home inspection, an appraisal, an engineering or code review, or a certification of your home. It is not prepared for use in a sale, a loan, an insurance claim or a legal proceeding. Luxewell is not a laboratory, a home inspector or a medical provider. The Home Baseline does not measure radon, carbon monoxide, chemical vapors or larger dust particles, and your report lists what it does not cover.

Not for emergencies. Nobody at Luxewell sees your readings until the box comes back, so nothing during your measurement week will warn you of a danger. The instruments do not replace smoke or carbon monoxide alarms. If you smell gas, an alarm sounds, or anyone feels unwell, leave the home and call 911 or your gas utility.

5. Who can order

You must be at least 18 years old and able to enter a binding agreement. You may order for a home you own or live in, or one where you have the permission of the owner and the people who live there to place the instruments. The box ships only to a street address, not a PO box, in the states listed on the order page. We may decline or cancel any order, for example where we cannot ship to the address or cannot verify payment; if we do, you are not charged.

6. Orders, prices and payment

• Prices are in US dollars and are shown on the order page before you pay. Any optional extras you choose, such as additional rooms, additional water tests or Equipment Protection, are listed as their own lines. Sales tax is added where it applies.
• When you are charged: your card is charged in full when you order. Your box ships within up to 8 weeks of your order, and we email you the day it does. If we expect to miss that time, we will tell you, and you may cancel for a full refund.
• Payment processing is handled by our payment processor, Stripe. We never see or store your full card number. Stripe's own terms apply to the payment.
• Your stored payment method is kept for one purpose only: a single charge if the instruments are not returned or come back damaged, as your order agreements describe. We will email you before any such charge.
• Signing up to hear when orders open costs nothing, takes no card, and does not reserve a ship date or a place in line.

7. Not a subscription

A Home Baseline is a single purchase. It does not renew, nothing is charged on a schedule, and there is no membership to cancel. A later measurement happens only if you place a new order for it.

8. The instruments and returning them

The instruments and cases remain the property of Luxewell at all times. You hold them only for your measurement week, and you agree to:

• use them only as the setup instructions describe, indoors, in the rooms you named;
• not open, take apart, alter, or remove labels from any instrument, and not sell, lend or give them to anyone else;
• keep them away from water, heat, children and pets, and handle them with reasonable care;
• send every case back in the box it came in, using the return label we provide, within the return window stated in your order agreements.

If the box is not returned within that window, or comes back with something missing or damaged, you may be charged as your order agreements describe: the replacement cost of what is missing or broken, plus the replacement charge stated there, up to the maximum stated there. If you added Equipment Protection, the cap stated in your agreement applies. We will contact you before charging anything, and we would far rather find a case that is late than charge you for one.

The laboratory's water kit is not Luxewell equipment. It has no return window and is never part of any equipment charge.

9. Cancellations and refunds

• Before your box ships: you can cancel at any time by emailing jared@luxewell.com or replying to any email about your order. We will cancel the order and refund the full amount to your card. Your bank decides when the refund shows, which is usually within 5 to 10 business days.
• If something fails on our side: if the kit, the readings or the report fail because of something on Luxewell's side, such as an instrument failing or a box arriving damaged, contact us as soon as you can. We will measure again at no charge or refund all or part of what you paid. We choose which, in consultation with you.
• Otherwise, after your box ships: once your box has shipped, your order is not refundable, because the shipping and the laboratory work for it have already been paid for.
• Refunds go back to the card you paid with. Nothing in this section limits any refund or other right the law gives you.

10. Your account

You sign in with a link sent to your email address. Keep access to that email account secure, give us accurate name, phone and shipping details, and tell us promptly if you think someone else has used your account. You are responsible for activity in your account that you authorize. You can ask us to close your account at any time.

11. Electronic records and messages

You agree that we may provide agreements, receipts, notices and your report electronically, by email or through your account, and that your electronic acceptance at checkout is your signature. We send emails about your order whether or not you receive our occasional updates. If you agree to order-update texts at checkout, the texting terms shown there apply as well.

12. Acceptable use

You agree not to:

• use the site for anything unlawful, or to harm or mislead anyone;
• try to get into accounts, data or systems that are not yours, or interfere with the site's security or operation;
• copy, scrape or collect the site's content or data by automated means, except as ordinary search engines do;
• upload anything unlawful, or any photograph that is not of your open cases in their rooms, or that shows other people without their permission;
• order under a false identity or with a payment method you may not use.

13. Our content and your report

The site and its text, photographs, design, the Luxewell name and logo, the report format and our methods belong to Luxewell or the people who license them to us, and are protected by law. You may view and print pages for your own personal use.

Your report and the readings behind it are yours to keep and to share as you choose. It is prepared for you, so anyone else who reads it does so for their own information and may not rely on it as if it had been prepared for them.

14. What you give us

When you send us setup photographs, room names, quiz answers, messages or other material, you let us use it to provide and improve the service, as the Privacy page describes. We do not publish anything that identifies you or your home. If you send us suggestions, we may use them without owing you anything.

15. Other companies

We rely on other companies to run the service, including our payment processor, our website host and database provider, our shipping software and carriers, the laboratory that tests your water, and the service that sends our email. Their own terms may apply to what they do. The site may link to studies, products or other websites we do not control, and we are not responsible for them. A business we mention is independent of Luxewell, and any work it does for you is between you and that business.

16. Disclaimers

Instruments measure within limits. Readings reflect the conditions in your rooms during your measurement week and can differ at other times. We take care to calibrate, place and read the instruments well, but we cannot promise that every reading is exact or that the site will always be available or free of errors.

To the extent the law allows, the site, the Home Baseline and your report are provided “as is” and “as available,” and Luxewell disclaims all warranties not expressly stated in these Terms or your order agreements, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

17. Limitation of liability

To the extent the law allows, Luxewell will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from these Terms, the site or the Home Baseline, and Luxewell's total liability for any claim relating to them will not exceed the amount you paid Luxewell for the order the claim relates to, or one hundred dollars ($100) if the claim does not relate to an order.

These limits do not apply to liability that the law does not allow to be limited, such as liability for fraud, or in some states for gross negligence or willful misconduct. Some states do not allow certain exclusions or limits, so some of these may not apply to you.

18. Indemnity

To the extent the law allows, you agree to cover Luxewell's reasonable losses and costs, including reasonable legal fees, from a claim by someone else that arises from your breach of these Terms, your misuse of the site or the instruments, or material you sent us. This does not apply to the extent a loss was caused by Luxewell.

19. Governing law and disputes

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of laws rules.

If you have a problem, please tell us first. Write to us at jared@luxewell.com, describing the problem and what you would like us to do. We will try in good faith to resolve it with you, and each of us agrees to allow 30 days for that before starting a legal proceeding, unless waiting would cause harm that cannot be undone.

If we cannot resolve it, any legal proceeding about these Terms, the site or the Home Baseline will be brought in the courts located in Bartow County, Georgia, and you and Luxewell consent to those courts' jurisdiction, unless the law where you live gives you the right to bring it elsewhere.

20. Changes to these terms

We may update these Terms from time to time. The date at the top shows when they last changed, and the new version applies from that date. A change never alters an order you have already placed: that order stays under the Terms and order agreements you accepted when you placed it.

21. General

These Terms, the Privacy page and the order agreements you accept are the whole agreement between you and Luxewell about their subject. If a court finds any part of them unenforceable, the rest stays in effect. If we do not enforce a part of them right away, we have not given up the right to enforce it later. You may not transfer your rights under them without our written permission; we may transfer ours to a business that takes over Luxewell, which will remain bound by them. Sections that by their nature should continue, such as those on the instruments, disclaimers, liability and disputes, continue after your order is complete.
